What changed: Added the purpose, limitations and reuse conditions of AI illustrations.

1. Nature of the service

The Site provides Japan travel "comfort" planning information, including rule-based comfort scores by month and region, hotel and crowd pressure, holiday overlap, weather, pollen, cherry blossoms, snow season, and major-event notes. All scores, articles, tables, and suggestions are general planning references only, are not guarantees, and are not professional, legal, financial, insurance, medical, visa, immigration, or travel-agent advice.

Using the Site does not create any professional advisory, fiduciary, travel-agent, agency, or client relationship between you and the Site or its operator. The Site is not a travel agency and does not provide booking, ticketing, insurance brokerage, visa, payment-processing, or travel-agent services. It does not control hotels, airlines, transport operators, event organizers, insurers, booking platforms, or other third-party providers. The Site does not replace official notices, medical advice, airline / hotel / transport terms, insurance terms, entry requirements, or destination safety guidance.

The service also includes itinerary drafts, a local itinerary structure checker, event calendars, and information about attractions, workshops and omamori. It is based on public sources and remote desk research; a source check does not mean an in-person visit, stay, purchase or test. Read the page-specific limitations and our Disclaimer alongside these terms. Our Privacy Policy separately explains data handling; using the Site is not consent to optional tracking.

2. Accuracy and your responsibility

The Site is provided "as is" and "as available." Hotel prices, room availability, event dates, transport arrangements, weather, pollen levels, disasters, entry requirements, public holidays, organizer rules, and government policies can change at any time. We try to cite official, organizer, or traceable sources, but we do not warrant that the content is complete, accurate, current, error-free, or suitable for your specific situation.

The Site's comfort scores, hotel-pressure notes, pollen labels, weather labels, holiday windows, event status, and month windows are simplified planning models or data summaries. They are not live prices, live room availability, official crowd forecasts, formal weather forecasts, measured pollen counts, medical judgments, or guarantees of savings, availability, admission, transport operation, or itinerary success. "Verified" means only that a traceable source supported the item as of the relevant checked date; events, transport, crowd-control rules, weather, ticketing, cancellations, postponements, or rules may change afterward.

We may correct, update, delete, or reclassify content, scores, sources, or event status from time to time. A correction, update, or response to an enquiry should not be understood as an admission that earlier content created legal liability, negligence, or a duty to compensate losses.

Before booking, paying, travelling, or changing an itinerary, you should verify the latest information with official websites, booking platforms, airlines, hotels, transport operators, insurers, qualified medical professionals, and relevant service providers.

Itinerary drafts and checks can miss stops, underestimate travel time or fail to detect an impractical plan. A high score or an absence of warnings does not confirm feasibility, accessibility, safety, reservations or suitability for children, older travelers or people with luggage. Check the actual travel date, opening hours, transfer and queue allowances, last services, admission conditions and your group's needs. Times are Japan local time unless the page states otherwise.

Shared links reproduce supported choices using the data available when opened; they are not fixed quotations or archived results. Saved images and screenshots may become outdated. Check the current page and official source before relying on them.

3. Health, weather, and safety notes

The Site may discuss hay fever, allergies, heat, cold, snow roads, typhoons, heavy rain, or other travel risks. This content is a general reminder only and is not medical or safety advice. If you have health conditions, severe allergies, mobility needs, pregnancy, older travelers, or children in your group, consult qualified professionals and official weather, transport, and safety sources.

4. Acceptable use and feedback

You may use the Site for personal travel planning and share its result links or downloaded result cards for non-commercial purposes, keeping source and limitation notices intact. These terms do not restrict uses permitted by applicable law or by a separate licence.

You must not attack or disrupt the Site, bypass security restrictions, impose unreasonable automated traffic, impersonate WhenJapan, misrepresent its results as official guarantees, or infringe others' rights. Except where legally permitted or separately licensed, bulk republication, mirror sites and commercial reuse of protected content require prior written permission. Crediting a source does not by itself grant permission to reproduce third-party material.

If you send feedback or corrections, submit only material you have the right to provide. You retain your rights and give us non-exclusive permission to review, verify and edit the material as needed to address your enquiry and improve the relevant content. This does not authorise publication of your personal details or private correspondence as a testimonial; we will seek separate permission for that. Personal data is handled under our Privacy Policy, not an unrestricted reuse licence.

5. Intellectual property

To the extent protected by law, original text, design, code, illustrations and the selection or arrangement of material belong to the WhenJapan operator or the relevant rights holders, subject to any stated licence. The copyright notice uses WhenJapan as the public brand name; it does not claim ownership of third-party works, public facts, dates, ideas or general calculation methods.

Third-party photographs, trademarks, characters, venue names and official material remain subject to their owners' rights and terms. A source link is not a licence to reuse that material, and inclusion does not imply sponsorship, endorsement or official affiliation. The WhenJapan notice does not override any open-source or third-party licence.

AI illustrations and image use

The Site uses AI-generated and AI-assisted illustrations to depict places or themes, with labels near the relevant images. They are not photographs, official images, maps or product catalogues. Building details, proportions, scenery, seasons and omamori designs may be simplified or differ from reality. Do not use an illustration to determine an actual route, accessible facilities, conditions on the day or a product's appearance.

The permission in section 4 to share result links and downloaded result cards does not separately authorise extracting illustrations for merchandise, advertisements, asset libraries or trademarks. Uses permitted by law or a separate licence are unaffected. For other uses, contact us to check the applicable rights and conditions; we can grant permission only for rights we are entitled to license. An AI label or our copyright notice does not guarantee exclusive copyright in every image or permission from third parties. Keep AI / non-photographic labels, sources and limitation notices when sharing result cards.

For a rights concern, email hello@whenjapan.com with the affected page and image URL (if applicable), the work concerned, your basis for acting and a reply address. Send links or the minimum evidence needed, without unnecessary personal information. We will review the concern and, where appropriate, correct, restrict or remove the material.

6. External links, sources, and third-party services

The Site may link to government, tourism-board, organizer, hotel-platform, transport, map, advertiser, or other third-party websites. Their content, prices, availability, cancellation, refunds, payments, insurance claims, transaction security, terms, and privacy policies are their responsibility. A link from the Site does not mean endorsement, warranty, or control over that third-party service.

7. Advertising and affiliate disclosure

The Site may display Google AdSense or other advertising and may contain affiliate links. If you complete a purchase through an affiliate link, the Site may earn a commission, usually at no additional cost to you. Where a specific article, list, or link includes an affiliate, sponsored, free-product, discount, paid partnership, or other material commercial relationship, the Site will disclose that clearly near the relevant content or link, not only in these terms, the footer, or the privacy policy. Advertising and affiliate content should not be treated as a warranty, endorsement, lowest-price promise, or recommendation of the relevant product, service, price, or provider.

8. Disclaimers and limitation of liability

Nothing in these terms excludes or limits liability for death or personal injury resulting from negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or limited. Every exclusion and cap below is subject to applicable law, including any requirement of reasonableness.

Subject to those safeguards, and only to the extent legally permitted, the Site and its operator exclude liability for losses arising from use of or reliance on the Site, including missed reservations, itinerary changes, delays, cancellations, additional travel costs, third-party service failures, and indirect or consequential losses. This does not remove responsibility that the law places on us for our own conduct.

Subject to the same safeguards, if the Site or its operator is found liable for a claim, the aggregate limit is the amount you actually paid to the Site for using it or HKD 100, whichever is higher. This limit applies only where lawful and enforceable; it does not establish that HKD 100 is reasonable for every claim or circumstance.

9. Suspension, changes, and termination

We may modify, suspend, or discontinue any content, feature, or page on the Site from time to time, and may reasonably restrict use that violates these terms or abuses the Site.

10. Changes to these terms

We will date revised terms on this page. Revisions apply to use after publication, or a later stated effective date, and do not retrospectively remove accrued rights. Material changes will receive a prominent notice; where the law requires consent, we will seek it rather than treat continued browsing alone as consent.

11. Governing law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region, with the Hong Kong courts as a non-exclusive forum. This does not affect any mandatory consumer-protection rights you may have where you live.

If there is any inconsistency between the Chinese and English versions of these terms, the Chinese version controls to the extent permitted by applicable law.

12. Severability

If any part of these terms is found invalid or unenforceable, the rest remains in effect. The relevant provision will be interpreted or modified, to the extent permitted by law, in a way that most closely reflects its original purpose.
